Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.
To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.

However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.

The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide..

If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.

So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law It doesn’t stop there though.
The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;

The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights… Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation to support the Constitution.” If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.

For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

So you can imagine my initial reaction when I received a billing notice purportedly from Verizon saying that my bill for $1397.13 was available online.

I immediately logged into my Verizon account and saw that I had (of course) paid my bill and that no amounts were due. Note that I didn’t click on the link from the email.

So I went back to my email inbox and saw that the phony Verizon email was received into my Scam-Spammer collection box and not the email address that I have on record with Verizon.

Then today I received another phony Verizon email thanking me for my payment of $1457.81.

Last night after I determined that the first email was another elaborate phishing attempt, I called Verizon and asked if they had a fraud department to which I could forward the phony email. They said. They apologized that I had received the phony email and assured me that my account was in order. They explained that: they were aware of the phishing emails; they would note my account; and they were investigating the phishing incidents.

So I’m thinking, how are they investigating when they are not even collecting the most basic of evidence? Doesn’t Verizon care?

Here’s what the email looks like:

When Tim Cook takes the stage on Wednesday, he is expected to announce that the new iPad will be called iPad 3HD. The new model will debut at $399 for a 16 MB model. The fully tricked out version will run you $799 but wait until you see what you get for your money.

To start with, the new iPad 3HD will have a massively improved display with no frame and no home button is expected.

Siri will also be making its iPad debut as Apple begins to position the iPad to control Apple’s long-awaited entry into the television market.

In addition to Siri, the new iPad will not only come with a cover but a Blue Tooth keyboard also. Apple expects the iPad to completely replace the laptop computer and the new keyboard will have the MacBook keyboard look and feel.

The iPad 3HD will also feature a new port. The most amazing port will be the video connection that is designed to for the new Apple iPad iScreen, a 15 inch, high resolution screen that will blow away anything else on the market.

Apple will also be doing away with the old-fashioned 30-pin connector that feeds the iPad’s power supply. And the new battery will yield up to 18 hours of video play.

The new iPad 3HD will be powered by 2 quad-core processors that will make the iPad 3HD seem like it’s flying. One would think that all of this power would zap battery life but Apple has designed a new charge pad on which you can place your iPad 3HD for a rapid and thorough charge.

The iPad 3HD will also come with a new feature–iPhone functionality. That’s right Apple fans, the new iPad 3HD-IP will also have iPhone functionality and will be sold exclusively through Sprint but not until September.

So what else could Apple do with the iPad? You will just have to wait for Tim Cook’s announcement. The fact is that no one knows what the new iPad will do (including BigNewsNow) until Apple is damn good and ready to tell us. So when you hear the tech media spewing what they think the new iPad will have, don’t believe a word of it. This article was a conglomeration of some of the most outrageous things that we’ve heard.

grant them amnesty, Social Security, free education, free lunches,

And so it came to pass that employers, facing spiraling costs and
ever-higher taxes, raised their prices and laid off workers. Others
simply gave up and went out of business and the economy sank like unto
a rock dropped from a cliff.

The banking industry was destroyed. Manufacturing slowed to a
crawl. And more of the people were without a means of support.

Then “The One” said, “I am the “the One”- The Messiah – and I’m here
to save you! We shall just print more money so everyone will have
enough!” But our foreign trading partners said unto Him. “Wait a
minute. Your dollar is not worth a pile of camel dung! You will have
to pay more… And “The One” said, “Wait a minute. That is
unfair!!” And the world said, “Neither are these other idiotic
programs you have embraced. Lo, you have become a Socialist state and
a second-rate power. Now you shall play by our rules!”

And the people cried out, “Alas, alas!! What have we done?” But yea
verily, it was too late. The people set upon The One and spat upon
him and stoned him, and his name was dung. And the once mighty nation
was no more; and the once proud people were without sustenance or

According to this bogus from “Humberto Tate my CPA license has been canceled due to tax return fraud accusations. This would indeed be troublesome if only we had a CPA license to begin with.

Subject Line: BBB Complaint.
This one is form risk@bbb.org. These are just hilarious because the English is outrageous: “Here with the Better Business Bureau informs you that we have been sent a complaint from one of your customers related to their dealership with you.”

And there was another one:
Subject Line: BBB Case Id 77947914
This one is from alerts@bbb.org. The opening sentence is identical to the one above. These came to us about 4 hours apart.

We will continue to provide examples of these ridiculous spam-scamming emails. Legitimate commercial marketers will always follow CAN-SPAM law requirements. BizGrowthProBlog has some information on the requirements.

And then there was this gem:
Subject Line: Income tax appeal rejected.
This beauty is from Riley Shepard
IRS.com? Really? This email says,

“Dear Business Onwer,” and goes downhill from there.

It tells me that “Hereby you are informed that your Income Tax Refund Appeal id#6632031 has been DECLINED. If you consider that the IRS did not properly examine you case due to a misunderstanding of the case details, be prepared to provide additional information.”

You can’t make this stuff up but somebody is. This is the kind of garbage that gives legitimate marketers a bad reputation.

You should also remember that the IRS, the AICPA, the Better Business Bureau, NACHA, FedEx, the US Postal Service and everyone else who is being tarnished by the scam artists will never communicate to you and ask you to click on blind links or send you forms (that you didn’t ask for) to download.

Be safe and be smart.

We’re not really sure where this originated but it provides a straight-forward, easy to understand example of the Barack Hussein Obama’s redistribution of wealth philosophy, a.k.a., tax the rich and screw the rest. Here goes:

Suppose that every day, ten men go out for beer and the bill for all ten comes to $100…

If they paid their bill the way we pay our taxes, it would go something like this…

The first four men (the poorest) would pay nothing.

The fifth would pay $1.

The sixth would pay $3.

The seventh would pay $7..

The eighth would pay $12.

The ninth would pay $18.

The tenth man (the richest) would pay $59.

So, that’s what they decided to do..

The ten men drank in the bar every day and seemed quite happy with the arrangement, until one day, the owner threw them a curve ball. “Since you are all such good customers,” he said, “I’m going to reduce the cost of your daily beer by $20″. Drinks for the ten men would now cost just $80.

The group still wanted to pay their bill the way we pay our taxes. So the first four men were unaffected. They would still drink for free. But what about the other six men? The paying customers? How could they divide the $20 windfall so that everyone would get his fair share?

They realized that $20 divided by six is $3.33. But if they subtracted that from everybody’s share, then the fifth man and the sixth man would each end up being paid to drink his beer.

So, the bar owner suggested that it would be fair to reduce each man’s bill by a higher percentage the poorer he was, to follow the principle of the tax system they had been using, and he proceeded to work out the amounts he suggested that each should now pay.

And so the fifth man, like the first four, now paid nothing (100% saving).

The sixth now paid $2 instead of $3 (33% saving).

The seventh now paid $5 instead of $7 (28% saving).

The eighth now paid $9 instead of $12 (25% saving).

The ninth now paid $14 instead of $18 (22% saving).

The tenth now paid $49 instead of $59 (16% saving).

Each of the six was better off than before. And the first four continued to drink for free. But, once outside the bar, the men began to compare their savings.

“I only got a dollar out of the $20 saving,” declared the sixth man. He pointed to the tenth man,”but he got $10!”

“Yeah, that’s right,” exclaimed the fifth man. “I only saved a dollar too. It’s unfair that he got ten times more benefit than me!”

“That’s true!” shouted the seventh man. “Why should he get $10 back, when I got only $2? The wealthy get all the breaks!”

“Wait a minute,” yelled the first four men in unison, “we didn’t get anything at all. This new tax system exploits the poor!”

The nine men surrounded the tenth and beat him up.

The next night the tenth man didn’t show up for drinks, so the nine sat down and had their beers without him. But when it came time to pay the bill, they discovered something important. They didn’t have enough money between all of them for even half of the bill!

And that, boys and girls, journalists and government ministers, is how our tax system works. The people who already pay the highest taxes will naturally get the most benefit from a tax reduction. Tax them too much, attack them for being wealthy, and they just may not show up anymore. In fact, they might start drinking overseas, where the atmosphere is somewhat friendlier.

The proposal will lower the “effective” tax rate on manufacturers to a top rate of 25%. That’s a decrease from the current 32%. But Obama plans to eliminate many of the huge deductions and subsidies for large oil companies.

The Obama plan also plans to tax overseas earnings of U.S. companies for the first time.

The prospect of higher corporate taxes will take yet another gouge from the pockets of American consumers.

According to Neal Boortz and John Linder’s book the The Fairtax Book, corporations and businesses don’t pay taxes. “When it comes right down to it, no corporation or business really pays taxes. The burden—all of it—falls on us.”

The Obama Regime’s continued call for higher taxes will ultimately prolong the stall economy’s stall. With the prospect of $4.00 per gallon gas prices on the near horizon, the American economy won’t have has little chance of a recovery in 2012. The Obama Regime knows that that it stands to lose billions in tax revenue because of high gas prices.

Americans buy less gas when prices go up and so fewer taxes are collected on gasoline sales.

Americans buy less gas because they make fewer trips. Fewer trips means they are visiting stores less often. And when they get to those stores, they have less money to spend because of higher gas prices. So stores sell less and begin laying off people.

Manufacturers have to reduce production because people are consuming less. They begin to lay people off.

Now even fewer people have the money they need for the basics–and the cost of basics go up and up.

The cost of shipping everything from asparagus and zucchini to diapers and gasoline itself goes up and those prices also get passed onto the consumer.

So where in all of this craziness does it make sense to raise taxes? When an American loses their job, they cut back on their spending.

When the Obama Regime collects fewer tax dollars, they raise taxes.

The answer is not now nor has it ever been to spend more tax dollars. The answer must be fiscal responsibility and that means making serious and painful cuts in government spending.

But that has not been the Obama way. Remember the $2 trillion ObamaCare plan? Everyone gets healthcare which sounds great but at the end of the day, the Obama socialist plan has been to enslave Americans. His policies are designed to make Americans more dependent upon government rather than challenge Americans to improve their economic condition through hard work and real employment.

Under Obama the American Dream is an economic nightmare. The Obama plan is to re-distribute wealth in America by overtaxing everyone and anyone so that he can give away welfare dollars, government pork projects and healthcare.

When Barack Hussein Obama was inaugurated in 2009, the price of a gallon of gas averaged $1.81 a gallon. According to the Christian Science Monitor the national average price for a gallon of gasoline is $3.52 as of today.

When Americans go to the polls in November, it will cost them more to drive there and when they’re standing in the voting booth ready to cast their vote they need to ask themselves, “Am I better off today than I was four years ago?”

And who can blame them? Times are tough and it is tax season, after all. Today. we received not one but two emails purportedly from the IRS–ah, but we know it was not the IRS, don’t we.

I mean, really, the IRS is NOT going to send you an email telling you about a refund. Why would they? They have your money and they’re going to keep it unless you initiate contact.

In fact, if you’re getting a refund, you’ve already screwed up because you’ve given the Obama Regime an interest free loan. And it’s money that they’ll keep unless you really, really ask for it. And the only way to do that is to fill out a bunch of forms.

As we mentioned, we received two emails today. The first subject line was:

“Tax refund notification.” The email was from Bonnie Sorenson who’s email address was ruleil@irs.gov.

Here’s the opening text from the email:

“After the last annual calculations of your fiscal activity we have concluded that you have a right to receive a tax refund of $102.
Please file the tax refund application and allow us 3-9 days in order to process it.

A refund can be hindered for many various reasons.
For instance, submitting invalid information or not meeting a deadline.”

The second email was from Buford Blackburn. The subject line was:

“Tax refund details.”

His email address was solingaa5451@irs.gov. Here’s the text from Buford’s email:

“After the last annual calculations of your fiscal activity we have estimated that you have a right to receive a tax refund of $221.
Please file the tax refund request and give us 3-9 days in order to process it.

A refund can be delayed for a range of reasons.
For example, submitting untrue information or applying after a deadline.”

Both emails are virtually identical but they are completely bogus.

So what should you do if you get one of these spam-scam emails? Easy. Just forward them to the IRS. Here’s their email address for these scams:

The email companies along with companies such as Bank of America, Facebook, Paypal and American Greetings have published the website DMARC.org.

DMARC stands for “Domain-based Message Authentication, Reporting & Conformance.” It is a technical specification created by these companies in an attempt reduce the potential for email-based abuse.

DMARC standardizes the way email receivers complete email authentication using the well-known and long-established SPF and DKIM mechanisms. Senders who use AOL, Gmail, Hotmail, Yahoo! and any other email receiver implementing DMARC will see consistent authentication results when their messages are sent.

DMARC.org hopes to encourage senders to more broadly authenticate their outbound email which can make email a more reliable way to communicate.

DMARC.org also has published a Frequently Asked Questions page that explains what email list owners can do to improve their email deliverability.
